Unaccompanied Juveniles Prohibited

Legislative provisions

Part 4, Division 9 of the Liquor Control Act 1988 (“the Act”) describes the situations in which juveniles can be present on licensed premises. The Act prohibits the sale and supply of liquor to a juvenile, for consumption either on or off licensed premises.  There are also policies of the Department of Local Government, Sport and Cultural Industries (Racing, Gaming & Liquor) which regulate juveniles on licensed premises.

Situations where juveniles are permitted to be on our licensed premises.

Juveniles are permitted to be on licensed premises when accompanied by, and under the supervision of a responsible adult. A person is considered to be a ”responsible adult‟ for the purposes of the Act, if that person is in ”loco parentis‟ (meaning in place of parent) of the juvenile. A legal guardian, parent, step-parent or other person who has control of and responsibility for a juvenile could be considered a responsible adult.  However, the decision to allow entry is entirely at the discretion of the licensee.

A responsible adult for this purpose is NOT, for example, an 18 year old boyfriend/girlfriend/work colleague/sister/brother etc

This does not apply to the presence of a juvenile employed by the licensee on the premises otherwise than in the sale or supply of liquor.

Whilst we may permit juveniles on our licensed premises who are accompanied by a responsible adult of the kind described above, liquor is not to be supplied to any juvenile on our premises.  If we consider that someone is supplying liquor to a juvenile on our premises we will require that person and the juvenile to leave the premises.  Further, we reserve the right to refuse to serve a juvenile at the bar even when the juvenile is wanting to purchase a non-liquor item.

Please respect our need to comply with liquor licensing laws and policies.
